New fee for resolving trademark oppositions, effective immediately.
On July 23, 2024, Resolution No. 295/2024 of the National Institute of Industrial Property (“INPI”) establishing new provisions for the procedure of resolving oppositions to trademark registration applications was published in the Official Gazette.
Fee for the administrative resolution of oppositions
The resolution introduces a new fee called “Administrative Resolution of Current Oppositions – APPLICANT FEE – SECTION 2° BIS of Res. 183/18,” to be paid by trademark applicants as a condition for National Directorate of Trademarks resolving oppositions filed by third parties against trademark registration applications. This fee is set at eight thousand nine hundred pesos ($8,900) and must be paid for each affected trademark application, regardless of the number of oppositions filed within fifteen (15) administrative business days as from the date the INPI notifies the applicant to make the payment. Failure to pay this amount will result in the automatic rejection of the registration application.
