The ANC is comprised by the Competition Tribunal, as adjudicator of decisions in both conduct and merger cases, and the Secretary for Anticompetitive Conduct Investigations and Secretary for Merger Review, each of whom will conduct their respective investigations, much in the way the CNDC used to act before the Secretariat.
The decree appointed Eduardo Montamat as President of the Competition Tribunal; and two out of four members of the Tribunal, Lucas Trevisani Vespa and Marcelo D’Amore. It also appointed Ana Parente as Secretary for Anticompetitive Conduct Investigations and Germán Zamorano as Secretary for Merger Review. All appointments were made on an interim basis, as the law requires them to be ratified by the National Senate.
The appointments align with Decree No. 803/2025, issued on 13 November 2025, which amended Articles 18 and 28 of Regulatory Decree No. 480/2018 to eliminate the previously required 60-day transition period before the ANC could begin operating. Under the amended rules, the ANC exercises their powers immediately upon constitution.
The ANC’s formal establishment triggers the one-year period set out in Article 84 of Competition Law 27,442. From that date, notifiable transactions may not be consummated without prior authorization from the ANC, and gun-jumping sanctions will apply for non-compliance. Before then, regulations are expected for, among other issues, the application of filing fees.
