ANPYN will act as the sole national port authority and the enforcement authority for applicable laws within its jurisdiction. It will succeed the SSPVN and AGP, meaning all references to the latter in ongoing agreements, contracts, or engagements will now refer to ANPYN.

 

The specific powers assigned to ANPYN include:

 

• Participating in the implementation of policies and plans concerning ports, dry ports, navigable waterways, river and maritime transport, and multi-modal logistics hubs, while promoting private investment.

 

• Supervising and auditing river and maritime transport services, as well as any services within its jurisdiction.

 

• Handling the procurement processes for services, public works, or public works concessions related to national navigable waterways and multi-modal or logistics hubs.

 

• Signing, negotiating, renegotiating, and amending contracts for public works, concessions, and services within its jurisdiction.

 

• Exercising the powers previously assigned to the SSPVN under Decree No. 709/24, including awarding the Main Navigable Waterway (known as the “Hidrovía”) concession tender, issuing and awarding tenders for other sections of national navigable waterways, and conducting a comprehensive review of the Hidrovía concession contract signed by the National Government and AGP.

 

• Acting as the Hidrovía concessionaire until the awardee(s) of the ongoing tender take(s) possession. Once the tender is awarded and the concession contract executed, ANPYN will oversee and supervise it, either directly or through third parties.

 

• Overseeing port services and interjurisdictional transport services while also acting as the enforcement authority for contracts related to dredging, re-dredging, maintenance, signaling, buoying, and hydro-logical control of national navigable waterways.

 

• Managing the Port of Buenos Aires and any other ports entrusted to it, including related, ancillary, or complementary activities such as implementing dry ports, logistic hubs, airport-port hubs, rail-port hubs, or multi-modal cargo transfer centers.

 

Our Commentary

 

This measure aligns with the objectives of modernizing state structures, reducing bureaucracy, and optimizing resources, as outlined in Executive Decree No. 70/23 and Law No. 27,742. By consolidating responsibilities for navigable waterways and port management –strategic sectors for foreign trade and economic development- into a single specialized body, the reform eliminates overlaps in authority and effort.

 

The specific powers granted to the new ANPYN reflect the administration’s intent to integrate river and maritime transport with other modes of transport, develop multimodal infrastructure systems, and foster private investment.
